AI Security and Privacy for Small Business
Data protection and security are not obstacles to AI in SMEs. They are prerequisites. This guide explains clearly which rules apply, how to comply with them, and which measures are realistic and affordable for SMEs.
Swiss Data Protection Law and AI
Since September 1, 2023, the revised Data Protection Act (revDSG) applies. For AI projects, four principles are particularly relevant: Purpose limitation means data may only be used for the purpose for which it was collected. If you collected customer data for invoicing, you cannot simply use it for AI-based marketing. Proportionality means only the data actually necessary for the purpose may be processed. Transparency means affected persons must be informed when their data is processed with AI. Data security requires appropriate technical and organizational measures to protect data.
For most SME AI projects, these requirements can be met with manageable effort. The key is to think about data protection from the start, not to bolt it on afterward.
What Data Does AI Process?
Not all data is equally sensitive. We distinguish three categories. Business data such as orders, inventory levels, revenue figures, and appointments is uncritical from a data protection perspective as it contains no personal data. Customer data such as names, addresses, email, purchase history, and communications is personal and subject to data protection law. Particularly sensitive data such as health data, financial information, and biometric data is subject to stricter rules.
For most SME AI projects, we process a mix of business and customer data. The good news: in many cases, we can work with anonymized or pseudonymized data, which significantly simplifies data protection requirements.
Technical Security Measures
Seven technical measures we implement in every AI project that are realistic for SME budgets: Encryption of all data at rest and in transit using TLS 1.3 and AES-256. Access control ensuring only authorized persons and systems can access data, with role-based access and regular permission reviews. Logging of all data access so that in case of an incident, it is traceable who accessed which data and when. Data minimization means AI only processes the data necessary for the respective use case. Regular backups of AI configuration and training data. Swiss hosting with all data processed and stored on servers in Switzerland. Regular security updates of AI software and all involved systems.
Organizational Measures
Beyond technology, organizational measures are equally important. Data protection impact assessment is recommended for AI projects with personal data. We conduct this for you and document the results. Employee training on responsible handling of AI and data is essential. Processing directory documenting which data is processed how and who has access. Data processing agreement, a contract between you and your AI partner that clearly regulates responsibilities. Regular review of security measures at least once annually.
AI and the Right to Information
The revDSG gives affected persons the right to information. If a customer asks: "What data do you have about me and what do you do with it?", you must be able to respond within 30 days. This means for your AI projects: document which customer data is processed by AI. Ensure you can identify individual customers in the AI system and export or delete their data. Prepare a process for handling information requests.
Checklist for Privacy-Compliant AI Projects
Use this checklist for every AI project: Is the processing purpose clearly defined? Is only necessary data processed? Are affected persons informed? Is data processing in Switzerland or an adequate country? Is encryption implemented? Is there access control? Are accesses logged? Is there a data processing agreement? Can information and deletion requests be processed? Has a data protection impact assessment been conducted?
Conclusion
AI security and data protection in SMEs is not rocket science. With the right technical and organizational measures, you can use AI while protecting your customers' and your company's data. The effort is manageable, the measures are proven, and an experienced AI partner will address these topics from the start.
